TERMS OF SERVICE
1. This is an experiment: assumption of risk
UAFC is an experiment, and it is published as one. It runs live on a public blockchain with a real ERC-20 token. Nothing about it is a finished, audited, or supported product. Every Fight is generated by AI models. Every winner is decided by an AI judge. Nobody, including the operator, knows the outcome before the judge has reviewed the finished video, and the judge can be wrong. YOU USE THE SERVICE ENTIRELY AT YOUR OWN RISK. By using it you accept that risk in full and you agree that the operator is not liable to you for any loss arising from it, to the fullest extent the law allows. Things that can go wrong, and will not be compensated: you can lose your entire stake because the other side won; a Market can be voided and your winning position turned back into a refund of your stake; a Fight can fail to generate or fail to be judged; a bug in the app, in the FightBook contract, in the generation systems, or in the judge can cost you a bet, a payout, or a claim; Robinhood Chain, an RPC provider, Privy, or a bridge can be slow, congested, or unavailable, so bets, results, refunds, and claims can be delayed or missed; a transaction can land after the close time and be rejected while the gas you spent is gone; and the Token can lose all of its value. This is an experiment, and we may change, pause, or shut the Service down at any time, including because it does not work well enough or is not worth continuing, with or without notice. If we shut it down: a Market that is still open can be voided by anyone once its resolve deadline has passed, which makes every stake in it refundable directly from the FightBook contract; a payout or refund you have already earned stays claimable from that contract whether or not the website is up; and a Fighter you minted can still be retired directly on the FighterRegistry contract to release its deposit to you, immediately while it is not locked into a Fight, or once the lock window has passed after you request retirement while it is. The website, the Fight generation, and the ability to start new Fights may simply stop. Blockchain transactions are irreversible. Neither you nor the operator can undo one. Only stake what you can afford to lose entirely, and do not use the Service with money you need. The rest of these Terms sets out the mechanics in detail. Read the sections on no warranty, limitation of liability, and no advice or guarantee of payout: they, together with this section, describe how much protection you have if the experiment goes wrong. The short answer is that you carry the risk.
2. Introduction and acceptance
These Terms of Service (the Terms) are an agreement between you and DappHero Corp (DappHero, the operator, we, us). They govern your use of the UAFC website, application, and related services (the Service), including any smart contract we deploy for it. By opening the Service, ticking the eligibility boxes, signing in, connecting a wallet, or placing a bet, you confirm that you have read these Terms, that you understand them, and that you agree to be bound by them, including the assumption of risk above. If you do not agree, do not use the Service. These Terms contain a class action waiver and a binding arbitration clause, in the dispute resolution section. Read that section carefully; it affects how disputes between you and DappHero are resolved.
3. Definitions
Fight: a short video contest between two fictional AI fighters, generated by DappHero's systems and shown in the Service. Fighter: a fictional character (name, likeness, statistics, personality) created for the Service. Fighters are not real people, animals, or machines. Token: the ERC-20 arcade token used to play DappHero's games, including placing stakes and receiving payouts in the Service, as identified in the app. The Token is a consumptive utility token, not an investment. Robinhood Chain: the Ethereum layer-2 network operated by Robinhood on which the FightBook contract is deployed. DappHero does not operate it. FightBook: the smart contract that holds stakes, records bets, applies the rake, and pays out or refunds. Market: the on-chain record for one Fight, with a red pool and a blue pool. Bet or stake: Tokens you transfer into a Market pool for one side. Close time: the time after which the Market accepts no further bets. Judge: the automated system that reviews a generated Fight and reports a winner or reports that it cannot decide. Resolved: the state of a Market after the operator has posted the Judge's winner. Void: the state of a Market whose stakes are refunded in full. Finalized: the state of a Resolved Market after the operator review window has passed; payouts are then fixed. Operator review window: the period after a Market is Resolved during which the Operator may still void it. Only the Operator, and the owner multisig that controls the Operator role, can do that. It is not a dispute process: there is no way for you to challenge a result, and nothing you do during the window can change one. Rake: the percentage of a Market's total pool retained by DappHero when the Market is Finalized. Operator: the DappHero-controlled account that creates, resolves, and voids Markets. Wallet: a blockchain account you control, whether you connected your own wallet or one was created for you through Privy when you signed in with email or Google.
4. Eligibility
You may use the Service only if all of the following are true: (a) You are at least 18 years old and have reached the age of majority where you live. If the law that applies to you sets a higher minimum age for staking on the outcome of a contest, that higher age applies to you instead. (b) You are not located in, resident in, or a citizen of a Restricted Jurisdiction. Restricted Jurisdictions are any country or region subject to comprehensive sanctions by the United States, the European Union, or the United Kingdom, and any place where betting on the outcome of a contest is unlawful for you. (c) You are not on any sanctions or restricted-party list, including the OFAC Specially Designated Nationals list, and you are not owned or controlled by anyone who is. (d) Betting on the outcome of a contest is legal where you are, and using the Service does not break any law that applies to you. (e) You have not previously been suspended or removed from the Service. The Service does not verify any of this. It checks eligibility only by asking you to confirm your age, your acceptance of these Terms, that you are not in a Restricted Jurisdiction, and that you understand the experiment and its risks. We rely entirely on your confirmation, and deciding whether you may lawfully use the Service is your responsibility, not ours. Giving a false confirmation is a breach of these Terms, and we may add identity, age, or location checks, or block access from particular places, at any time and without notice. Using a VPN, proxy, or any other tool to hide your location or evade a restriction is prohibited.
5. What the Service is
UAFC shows Fights between fictional AI Fighters and lets eligible users bet Tokens on which Fighter will be declared the winner. Fights are generated by software; they are not recorded from real events and nothing in them is real. DappHero operates the website, generates the Fights, runs the Judge, and controls the Operator account. DappHero does not hold your Tokens or your keys: stakes sit in the FightBook contract on Robinhood Chain until the Market pays out or refunds, and payouts move directly from the contract to your Wallet when you claim them. UAFC is not a bookmaker offering fixed odds. It is not a bank, broker, exchange, investment adviser, or custodian. Nothing in the Service is financial, investment, legal, or tax advice. The multipliers shown in the app are estimates derived from the current pool sizes and change until the close time.
6. Parimutuel pools, rake, and settlement
Every bet on a Fight goes into one of two pools, red or blue. When a Market is Finalized, the rake is deducted from the combined pool once, and the remainder is shared among bettors on the winning side in proportion to their stakes. There are no fixed odds: the multiplier you see when you bet is an estimate that can change as other people bet before the close time. Your final payout depends on the pool sizes at close. The rake for each Market is a percentage fixed on-chain when that Market is created, and the app shows the rate that applies to the Market you are betting on. These Terms deliberately do not restate the rate, so that the app and the contract remain the only places it is stated. DappHero may set a different rake for future Markets but never for a Market that already exists. The contract uses integer arithmetic and rounds down at each step. Small rounding differences between the app's estimate and the on-chain payout are expected and are not errors. If nobody bet on the winning side, no rake is taken and all stakes are refunded in full. Administrative controls. The FightBook contract gives its owner the power to pause it, to change the rake, minimum bet, and timing windows for future Markets, and to withdraw accrued rake. The Operator can create, resolve, and void Markets as described in these Terms. If the Operator fails to resolve a Market within the on-chain deadline after its close time, anyone may void that Market, and all stakes become refundable.
7. AI-generated Fights and AI judging
Fights are produced by generative AI video systems from a description of the two Fighters. The outcome is not scripted in advance and is not known to anyone, including DappHero, until the Judge has reviewed the finished video. Fighter records, statistics, and personalities are fictional flavour and do not predict outcomes. The Judge is an automated system that reviews the generated Fight and reports which Fighter won. It can misread a video, disagree with what you see, or fail to decide. Its decision, once posted on-chain by the Operator, is final unless the Operator voids the Market within the operator review window. Only the Operator can do that; you cannot challenge a result. You accept that the Judge's decision may differ from your own view of the Fight, that this is a normal outcome of an experiment built on AI models, and that it is not a basis for a refund or a claim against DappHero. A generated video may contain glitches, be shorter or longer than expected, or fail to render. Where a Fight cannot be generated or judged, the Market is voided, as described in the section on voided Fights and refunds. We may publish the Judge's reasoning with the result. Doing so is a courtesy and does not create a right of appeal.
8. AI-generated content
Everything you see in a Fight is synthetic. The Fighters are fictional characters invented for the Service: their names, likenesses, portraits, voices, records, statistics, and personalities are generated by AI models and do not depict, and are not intended to depict, any real person, living or dead, or any real animal, organisation, event, or place. Any resemblance to a real person or entity is unintended and coincidental. Fight videos are not footage. Nothing in them happened. No real fight, injury, or contest is being recorded, broadcast, or reported. AI-generated media can be flawed, strange, or wrong in ways nobody anticipated. It can produce artefacts, inconsistencies, or output that does not match the Fighter description it was given. Treat everything the Service shows as fiction produced by a machine. If you believe a generated Fighter or Fight depicts you, or infringes a right you hold, contact us at https://github.com/dennisonbertram/agent-wars/issues and we will review it and remove or regenerate the content where appropriate.
9. Player-made fighters
You may create a Player-made fighter by describing it in the create flow. By submitting a description you grant DappHero a worldwide, royalty-free licence to that description and to the name, look, bio, portrait, and Fight videos our systems generate from it. DappHero owns the generated media. A fighter is immutable once minted: its compiled description, name, and portrait are fixed and cannot be edited after that point. The fighter is an ERC-721 token. It is transferable, and future owner rewards under the next section follow whoever holds the token when a Market for that fighter is created, not who created or previously held it. Retiring a fighter returns its lock deposit and ends its future earnings; it does not undo the licence you already granted or affect a Fight the fighter already appeared in. DappHero may retire or delist a Player-made fighter that violates the content policy below. When we do, the fighter is taken out of matchmaking; you keep the ability to retire the token yourself and recover the deposit that way.
10. Content policy
Every fighter description is reviewed before it can be minted. We reject a description that depicts or names a real or recognisable person, a public figure, a politician, or a celebrity, or that is written "in the style of" one; a minor or an ambiguous age; hate, sexual, or degrading content; weapons, animals, robots, or any non-human subject; a real brand, logo, or trademark; or instructions aimed at our generation or judging systems, including text meant to change a Fight's outcome or to appear on clothing. A rejected description, or one sent back for an edit, is not charged; the creation fee is only taken when you mint. Your description and the review outcome are sent to a third-party AI model for moderation and are kept for moderation audit, as described in our Privacy Policy. Your own words are never the generation prompt. Our model compiles a safe description from what you wrote; the image and video generators see only that compiled text, and the Judge sees only the finished Fight video, never your text or the compiled description.
11. Creation fee, lock deposit, and owner share
Minting a fighter costs a creation fee and a lock deposit, both set on-chain and shown in the app before you mint. The creation fee is paid to the treasury and is not refundable. The lock deposit is returned to you in full when you retire the fighter. When a Market in which your fighter appears is Finalized, the owners of the two fighters share 20% of that Market's rake: 12% to the winning fighter's owner and 8% to the losing fighter's owner. When the other corner is a house fighter, the house share stays with the treasury. Your share is credited to a claimable balance that you claim yourself; it is not sent automatically. The owner paid is whoever holds the fighter's token at the moment the Market for that Fight is created, not necessarily who created the fighter. The fee and deposit shown to you before minting apply to that mint: the deposit returned on retirement is the amount you locked, whatever the current setting. The owner share ratio applies per Fight at the time its Market is Finalized; DappHero may change it for future Fights by updating these Terms. Owner rewards are paid out of the rake already disclosed elsewhere in these Terms; they are never an extra deduction from your stake or your payout.
12. Voided Fights and refunds
A Market may be voided, and all stakes refunded, in these cases: the Fight cannot be generated; the Judge cannot decide a winner with confidence; the Operator determines during the operator review window that the posted result was wrong; the Operator misses the on-chain resolution deadline and anyone voids the Market; or DappHero reasonably believes the Market was affected by a bug, an attack, manipulation, or a legal requirement. When a Market is void, every bettor on both sides can claim back exactly what they staked, with no rake and no multiplier. A void result can replace a Resolved result only during the operator review window, and only the Operator (or the owner multisig behind it) can do it; there is no user challenge. The window for each Market is set on-chain when the Market is created; the current default is ten minutes after the result is posted. Once it has passed, the result is Finalized and cannot be changed by anyone, including DappHero. If you had a winning position on a Market that is later voided within the operator review window, you receive your stake back rather than a payout. This is the only remedy. Voids are not refunds of gas. Network fees you paid to place a bet or to claim a refund are not returned.
13. Claims, gas, and transaction finality
Payouts and refunds are not sent to you automatically. You must claim them by sending a transaction from your Wallet to the FightBook contract, either from the app or directly. Unclaimed amounts stay in the contract; there is currently no deadline to claim, but we may introduce one for future Markets with notice in the app. Every bet, claim, and Token approval is a transaction on Robinhood Chain and needs a small amount of ETH on that network for gas. DappHero does not pay your gas unless the app states that gas is sponsored for your Wallet type. Bridging ETH to Robinhood Chain is done through third-party bridges at your own risk. Once a transaction is confirmed on-chain it cannot be reversed by you or by DappHero. Bets are accepted only before the close time; a bet transaction that lands after the close time is rejected by the contract and the Tokens stay in your Wallet, but any gas spent is lost. The app shows a countdown, but the contract enforces the close time using blockchain time, not your clock. Minimum bet amounts are enforced by the contract and shown in the app.
14. Wallets, sign-in, and third-party services
You sign in through Privy, a third-party authentication provider, using email, Google, or an external wallet. If you sign in with email or Google and have no wallet, Privy creates an embedded wallet for you. DappHero never sees or stores your private keys or recovery material. You are responsible for keeping control of your email account, Google account, wallet, and devices; anyone who controls them can bet, claim, and move Tokens as you. The Service depends on services that DappHero does not operate, including Privy, Robinhood Chain and its sequencer, RPC node providers, the Blockscout block explorer, bridges, and the video-generation and AI providers used to produce Fights. Each has its own terms and privacy practices. DappHero is not responsible for their availability, accuracy, fees, or failures, and a failure of any of them may delay or prevent bets, results, or claims. We may add, replace, or remove third-party services at any time.
15. The Token (arcade token)
The Token is an arcade token: a utility memecoin you use to play DappHero's games, including staking on Fights and receiving payouts in the Service. That is its only intended use. It is not money, a security, a share, a bond, a derivative, a deposit, or an investment contract, and it is not intended to be one. It carries no ownership, governance, dividend, revenue, or redemption rights against DappHero, and DappHero does not buy back, redeem, or exchange it for cash. DappHero makes no promise about the Token's price, liquidity, or usefulness outside the Service, and nothing in the Service, its copy, or its chat should be read as a suggestion that the Token will hold or gain value. DappHero does not sell the Token, does not exchange it for money or other assets, and does not offer any way to cash it out. The Token was launched through a third-party token launchpad, pons (operated by Pons Labs, LLC, ponsfamily.com), on Robinhood Chain, that DappHero does not operate or control; any market for the Token on that launcher or on other venues exists independently of DappHero, and the Token's value may fall to zero. You acquire and use Tokens for entertainment, not as an investment, and you are responsible for any tax that applies to your stakes, payouts, or Token holdings. The Token may be transferable and third parties may trade it; DappHero does not operate a market for it and makes no representation about its value. The eligibility and restricted-jurisdiction rules in these Terms apply to all use of the Service regardless of how the Token is characterised. Robinhood Chain is operated by Robinhood. DappHero, UAFC, and the Token are not affiliated with, endorsed by, or sponsored by Robinhood Markets, Inc. or any of its affiliates, and the name is used only to identify the network on which the contract runs.
16. Fight chat and user content
The Service may include a chat panel. When it is live, anything you post is visible to other users and may be stored by us. You keep ownership of what you write and grant DappHero a worldwide, royalty-free licence to display, store, moderate, and remove it in connection with the Service. Do not post anything unlawful, defamatory, harassing, sexually explicit, or hateful; anything that impersonates a person or DappHero; personal information about others; spam or advertising; or messages intended to mislead other bettors about a Fight, a pool, or a result. We may remove content and suspend chat access without notice. In development and demonstration modes the chat shows simulated messages from fictional users. Simulated messages are not statements by real bettors and are not information about real bets.
17. Prohibited conduct
You must not: (a) use bots, scripts, or automated tools to place bets, claim payouts, or interact with the Service, other than a standard wallet; (b) attempt to influence a Fight, the Judge, or a result, including by attacking or manipulating the generation or judging systems; (c) exploit a bug in the Service or the contract, or bet on a Market you know to be malfunctioning; (d) use multiple accounts or Wallets to evade a restriction or limit; (e) evade eligibility, location, or sanctions controls, including with a VPN; (f) use the Service to launder money, finance terrorism, or handle proceeds of crime; (g) use the Service on behalf of a Restricted person; (h) interfere with the Service's infrastructure, scrape it, or overload it; (i) reverse-engineer, copy, or resell the Service or its content; or (j) use the Service in any way that breaks a law that applies to you or to DappHero. If you find a bug that affects stakes, results, or payouts, report it to https://github.com/dennisonbertram/agent-wars/issues instead of using it.
18. Intellectual property
DappHero owns, or holds licences to, the Service, the UAFC name and logo, the Fighters (their names, likenesses, descriptions, and records), the Fight videos and images, the sound, the interface, and the underlying software and smart contracts, in each case to the extent those things are protectable under applicable law. Generated video and images are protected to the extent the law allows. We grant you a personal, revocable, non-transferable licence to use the Service and view its content for your own non-commercial use. You may share links and short clips for commentary if you credit UAFC and do not imply endorsement. Anything else, including selling merchandise with Fighters, training AI models on Fight videos, or building a competing product from our content, needs our written permission. The FightBook contract source is published under the licence shown in its repository; that licence, not this section, governs the code. Any feedback you send us may be used without obligation to you.
19. Your representations
Each time you use the Service you represent that: you meet the eligibility conditions set out above; the Tokens and ETH you use are lawfully yours; you understand that the Service is an experiment and that you are using it entirely at your own risk; you understand how parimutuel pools, the rake, the Judge, and voids work; you understand that blockchain transactions are irreversible; you are not relying on DappHero for financial advice; you will comply with these Terms and all laws that apply to you; and you have not been sanctioned or barred from using services like this one.
20. No advice, and no guarantee of payout
Nothing in the Service is advice. Not financial, investment, trading, legal, tax, or accounting advice, and not a recommendation to place any bet, to acquire the Token, or to keep holding it. The multipliers, pool sizes, countdowns, fighter records, statistics, personalities, chat messages, and any commentary the Service shows are entertainment and estimates. They are not predictions, not signals, and not a representation that any outcome is more or less likely. Decide for yourself, or take advice from someone qualified to give it. We do not guarantee that you will be paid. We guarantee no return, no profit, and no positive expected value. A bet on the Service is not an investment, a deposit, a savings product, or a security, and it is not protected by any deposit insurance, investor compensation, or gambling regulator's guarantee scheme. More specifically, DappHero does not promise that: any Fight will be generated, judged, or settled, on time or at all; the Judge will decide the way you think it should; a Market you bet on will not be voided; a payout or refund will be claimable when you try to claim it; the on-chain result will match what the app displayed at any given moment; or the Token will hold any value at all. Payouts come out of the FightBook contract, not out of DappHero's pocket. If a bug, an exploit, a chain failure, or an operational mistake leaves the contract unable to pay you, DappHero is not obliged to make you whole, and we make no promise, express or implied, that we will.
21. No warranty
THE SERVICE IS PROVIDED AS IS AND AS AVAILABLE, WITH NO WARRANTY OF ANY KIND. The Service, the Fights, the Fighters, the Judge, the app, the FightBook contract, and all content are provided without warranties of any kind, whether express, implied, or statutory, including any implied warranty of merchantability, fitness for a particular purpose, title, accuracy, non-infringement, and uninterrupted or error-free operation. In particular, DappHero does not warrant that: the Service is fit for any purpose at all; Fights will be generated or judged on time or at all; the Judge will decide correctly; the app's displayed pools, multipliers, or countdowns match the on-chain state at every moment; the FightBook contract is free of bugs or has been audited; Robinhood Chain, RPC providers, Privy, or bridges will be available; that defects will be corrected; or that the Token will keep any value. No advice or information, whether spoken or written, that you obtain from DappHero or through the Service creates any warranty that is not stated here. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you. Where an exclusion is not permitted, our warranties are limited to the minimum period and extent permitted by that law.
22. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DAPPHERO, ITS OWNER, ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, CONTRIBUTORS, AFFILIATES, AND ITS SERVICE PROVIDERS (TOGETHER, THE PROTECTED PARTIES) ARE NOT LIABLE TO YOU FOR ANY LOSS ARISING FROM OR RELATED TO THE SERVICE. This covers, without limitation: lost stakes; lost, reduced, delayed, or unclaimable payouts and refunds; a Market that is voided; a Judge decision you disagree with; lost or stranded Tokens or ETH; gas spent on a transaction that failed, reverted, or arrived too late; loss of profit, revenue, opportunity, goodwill, or data; and any indirect, incidental, special, consequential, exemplary, or punitive damages. It applies whether the claim is in contract, tort (including negligence), strict liability, or any other theory, and it applies even if a Protected Party was told such loss was possible and even if a limited remedy is found to have failed of its essential purpose. It applies to loss caused by bugs or vulnerabilities in the app or in the FightBook contract; by failures, errors, or unexpected output of the AI generation or judging systems; by the acts, omissions, downtime, or fees of Robinhood Chain, its sequencer, RPC providers, Privy, bridges, block explorers, hosting providers, or AI and video providers; by network congestion, reorganisation, censorship, or a chain halt; by attack, exploit, or manipulation by any person; by a pause, upgrade, or administrative action on the contract; and by your own loss of keys, credentials, or devices. To the maximum extent permitted by applicable law, the total aggregate liability of the Protected Parties to you for all claims arising from the Service in any twelve-month period is limited to the greater of (a) the rake actually paid by you on the Market giving rise to the claim and (b) one hundred US dollars. You accept that these limits are a fair allocation of risk for an experiment that is offered to you free of charge apart from the rake, and that DappHero would not operate the Service without them. Nothing in these Terms excludes or limits liability for fraud or fraudulent misrepresentation, for death or personal injury caused by negligence, or for any other liability that cannot lawfully be excluded or limited. Some jurisdictions do not allow some of the exclusions or limits above; where that is so, the excluded or limited liability is reduced to the minimum permitted by that law rather than removed, and the rest of this section still applies.
23. Indemnity
You agree to defend, indemnify, and hold harmless DappHero and its officers, directors, employees, contractors, and affiliates from any claim, loss, liability, damage, cost, or expense (including reasonable legal fees) arising from: your use of the Service; your breach of these Terms; a false eligibility confirmation; your chat content; your violation of any law or of a third party's rights; or any tax obligation of yours. We may take over the defence of any matter covered by this indemnity, and you agree to cooperate.
24. Suspension and termination
We may suspend or end your access to the Service, or to any feature, at any time, with or without notice, including if we believe you are ineligible, have breached these Terms, are acting abusively or fraudulently, or if a law or a service provider requires it. Because stakes are held by the contract and not by us, suspending your access to the app does not by itself affect your ability to claim a payout or refund directly from the contract, unless the contract is paused. You may stop using the Service at any time. Sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnity, governing law, and dispute resolution) survive termination.
25. Changes to the Service and to these Terms
We may change, pause, or discontinue any part of the Service, including Fighters, Fight formats, the rake for future Markets, and supported networks, at any time. We may change these Terms. When we do, we will post the revised Terms in the app with a new Last Updated date, and for material changes we will show a notice in the app. Changes take effect when posted, except that changes to the dispute resolution section apply only to disputes that arise after the change. Continuing to use the Service after a change means you accept the revised Terms. If you do not accept them, stop using the Service; you can still claim any payout or refund you are owed directly from the contract.
26. Governing law
These Terms and any dispute arising from them or from the Service are governed by the laws applicable to the operator's place of business, without regard to conflict-of-laws rules, and the courts and arbitral seat of that place have jurisdiction. If you cannot accept uncertainty about governing law, do not use the Service. The operator will name that jurisdiction here once it is settled. Until then, this is one more respect in which the Service is an experiment offered on the terms described above. If you are a consumer in a jurisdiction whose law gives you protections that cannot be overridden by contract, those protections still apply, and nothing in this section deprives you of the right to bring proceedings in the courts of the place where you live where that law gives you that right.
27. Dispute resolution and class action waiver
Informal resolution first. Before starting any formal proceeding, you agree to contact us at https://github.com/dennisonbertram/agent-wars/issues describing the dispute, your Wallet address, and what you want, and to give us thirty days to try to resolve it informally. We agree to do the same before starting a proceeding against you. Binding arbitration. Except for the small-claims and injunctive carve-outs below, any dispute between you and DappHero arising from these Terms or the Service that is not resolved informally will be settled by final, binding arbitration before a single arbitrator, seated at the operator's place of business, under the rules of an established arbitration provider chosen by the operator when the arbitration is commenced, conducted in English, with remote hearings permitted. The arbitrator decides all questions about the scope and enforceability of this clause. Judgment on the award may be entered in any court with jurisdiction. Carve-outs. Either party may bring an individual claim in small-claims court if it qualifies, and either party may seek an injunction in court to protect intellectual property or to stop unauthorised access to the Service. Class action and jury waiver. You and DappHero each agree to bring claims only in an individual capacity and not as a plaintiff or class member in any class, collective, or representative proceeding, and each waive any right to a jury trial. If this waiver is found unenforceable for a particular claim, that claim must be heard in court, not in arbitration, and the rest of this section still applies. Opt-out. You may opt out of the arbitration and class waiver provisions by contacting us at https://github.com/dennisonbertram/agent-wars/issues within thirty days of first accepting these Terms, stating your name, Wallet address, and that you opt out. Opting out does not affect any other part of these Terms. Time limit. Any claim must be started within one year after it arises, or as long as the applicable law requires if that is longer. Where the law that applies to you does not permit part of this section, that part does not apply to you and the rest still does.
28. General terms
These Terms, together with the Privacy Policy, are the entire agreement between you and DappHero about the Service. If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them to an affiliate or a successor. Nothing in these Terms creates a partnership, agency, or fiduciary relationship. Notices to you may be given in the app or to the email address associated with your sign-in. Where these Terms are translated, the English version governs.
